Piecework agreement

New minimum hourly wage guarantee for pieceworkers for Horticulture Award

The Fair Work Commission has made a decision to include a minimum hourly wage guarantee and a requirement to record hours worked by pieceworkers into the Horticulture Award. This decision is not yet law.

The information in this resource explains the current minimum entitlements that apply as per the current state of the law. We will continue to monitor this matter and review and update the information in the resource.

Before you begin: To prepare your piecework agreement you'll need to:

  • confirm that either the Horticulture Award or the Wine Industry Award applies to the employee; and
  • know the piecework rates that you’re offering the employee.

The requirements for a piecework agreement may be different under an applicable enterprise agreement.

The piecework rates must be sufficient to meet the award requirements, and should take into consideration factors such as the experience of the workforce, the size of the operation and the quality of the crop. Your piecework rates need to be regularly reviewed to ensure that you meet any changes to the award or the working conditions.

Is the employee under 18 years of age?

If an employee is under 18 years of age when making a piecework agreement, a parent or guardian’s signature is required under the Wine Industry Award.

The Horticulture Award does not require a parent or guardian to co-sign the agreement, but it's considered best practice and may be required by state legislation.
